These Terms of Use (“Terms”) govern your access to and use of the WorkProofCam iOS application (“App”) offered on the Apple App Store by the WorkProofCam Team. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms are between you and the WorkProofCam Team, not Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for claims by you or any third party relating to the App, including product liability claims, failure to conform to legal or regulatory requirements, or consumer protection claims. Apple is not responsible for investigation, defense, settlement, or discharge of any intellectual property infringement claim. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Subject to these Terms and Apple’s Standard Licensed Application End User License Agreement (Apple Standard EULA), we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, solely as permitted by Apple’s Usage Rules.
WorkProofCam helps you capture job proof photos, attach timestamps, GPS coordinates, addresses, and notes when available, organize before/after proof points, and generate PDF reports. You are responsible for how you capture, label, export, and share job records.
The App is a documentation tool. It does not provide legal, insurance, safety, engineering, inspection, employment, or contractual advice. PDF reports, photos, timestamps, locations, and notes may not satisfy legal, insurance, workplace, evidentiary, or contractual requirements. You are responsible for verifying records and complying with all applicable rules for your work, job site, client, employer, or jurisdiction.
Camera output, timestamps, GPS coordinates, and reverse-geocoded addresses depend on your device, iOS, permissions, signal quality, and system services. They may be unavailable, delayed, incomplete, or inaccurate. You should review reports before sharing or relying on them.
You retain ownership of photos, notes, job details, company names, and other content you create in the App. You grant us only the rights necessary to operate the App on your device, such as storing, displaying, processing, and exporting that content locally. You represent that you have all rights and permissions needed to capture and use your content. Additional rules are described in our User Content & Acceptable Use Policy.
Our handling of information is described in the Privacy Policy. The App is designed to store job records locally on your device and does not provide cloud sync in the current version.
The App may offer Pro features through Apple’s in-app purchase system, including expanded job limits, PDF exports, and branded reports or watermarks. Purchase availability, pricing, taxes, billing, renewal where applicable, cancellation, refund handling, and purchase management are governed by Apple’s terms and policies, including the Apple Standard EULA. You can manage eligible purchases or subscriptions in your Apple ID account settings.
You agree not to misuse the App, including by using it unlawfully, violating privacy or intellectual property rights, capturing content without required consent, interfering with the App’s security, reverse engineering except as permitted by law, or using reports to misrepresent facts.
When you share a PDF report or photo through Mail, Files, AirDrop, Messages, cloud storage, or another destination, that destination’s terms and privacy practices apply. We are not responsible for third-party services or for what recipients do with content you share.
We may update, modify, suspend, or discontinue features. We may update these Terms by posting a revised version with a new effective date. Your continued use of the App after changes constitutes acceptance unless applicable law requires otherwise.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT REPORTS WILL MEET ANY PARTICULAR EVIDENCE, AUDIT, INSURANCE, OR WORKPLACE STANDARD.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, BUSINESS, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP OR IN-APP PURCHASES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE U.S. DOLLAR (US$1), IF YOU PAID NOTHING. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless the WorkProofCam Team from claims, damages, losses, liabilities, and expenses arising from your content, your use or misuse of the App, your exported reports, your violation of these Terms, or your violation of applicable law or third-party rights, except to the extent caused by our gross negligence or willful misconduct.
We may suspend or terminate your license if you materially breach these Terms. You may stop using the App at any time. Sections that by their nature should survive termination will survive.
Unless mandatory consumer protection laws in your country or region require otherwise, these Terms are governed by the laws applicable to the developer entity identified on the App Store, without regard to conflict-of-law principles.
