These Terms of Use ("Terms") govern your access to and use of the UseSoon mobile application ("App") offered on the Apple App Store. By downloading, installing, purchasing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms are between you and the UseSoon Team, not Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to furnish maintenance or support for the App. Apple is not responsible for addressing claims by you or any third party relating to the App, including product liability claims, failure to conform to legal or regulatory requirements, or consumer protection claims. If the App infringes a third party's intellectual property rights, Apple is not responsible for investigation, defense, settlement, or discharge of that claim. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Subject to these Terms and Apple's Standard Licensed Application End User License Agreement (Apple Standard EULA), we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, and as permitted by Apple's Usage Rules.
UseSoon may offer auto-renewable subscriptions and one-time in-app purchases through Apple's in-app purchase system. Available plans may include monthly Pro access, yearly Pro access, and lifetime Pro access. Pro features may include higher or unlimited food tracking limits and package date scanning, as described in the App at the time of purchase.
Payment is charged to your Apple ID account at confirmation of purchase. Auto-renewable subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account may be charged for renewal within 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID subscription settings. Free trials, if offered, are handled by Apple and may convert to a paid subscription unless canceled before the trial ends. Refund requests are handled by Apple according to Apple's policies.
The App helps you organize food expiration dates and reminders. It does not provide food safety, medical, nutritional, or professional advice. OCR results, detected dates, reminder timing, and expiration calculations may be incomplete or inaccurate. You are responsible for checking product labels, storage conditions, smell, appearance, safety notices, and applicable guidance before consuming or discarding food.
You retain ownership of food names, photos, dates, notes, settings, and other information you enter or choose to save in the App. You grant us only the rights necessary to operate the App on your device, such as storing, displaying, scanning, and processing your content locally. Prohibited content and acceptable use standards are described in our User Content Policy.
You agree not to misuse the App, including by attempting to reverse engineer the App except as permitted by law, bypass purchase controls, interfere with security features, violate third-party rights, or use the App in violation of applicable law or Apple's rules.
We may release updates that add, change, or remove features. We may also update these Terms. The "Effective date" above indicates the latest version. Your continued use of the App after changes constitutes acceptance unless applicable law requires additional notice or consent.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, FOOD, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE U.S. DOLLAR (US$1), IF YOU DID NOT PAY ANY AMOUNT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You will defend, indemnify, and hold us harmless from claims, damages, losses, and expenses arising out of your content, your misuse of the App, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.
We may suspend or terminate your license if you materially breach these Terms. You may stop using the App at any time. Provisions that by their nature should survive will survive termination.
Unless mandatory consumer protection laws in your country of residence require otherwise, these Terms are governed by the laws applicable to the developer entity identified on the App Store, without regard to conflict-of-law principles. Courts in that jurisdiction may have exclusive jurisdiction, subject to non-waivable consumer rights.
