These Terms of Use ("Terms") govern your use of Progress Camera (the "App") provided by Progress Camera Team ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms.

1. Apple App Store Terms

The App is distributed through Apple's App Store. Apple is not responsible for the App, its content, maintenance, or support, except as required by Apple's applicable rules. These Terms are between you and us, not Apple.

2. License

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, as permitted by Apple's Usage Rules and the App Store terms.

3. Apple Standard EULA

Your use of the App is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA"), unless a separate custom EULA is provided for the App. If these Terms conflict with the Standard EULA about your licensed use of the App, the Standard EULA controls to the extent required by Apple.

4. App Functionality

Progress Camera helps you create local progress-photo series, record body measurements, review trends, compare before-and-after check-ins, align repeat photos, save generated comparison images, and share exported images through iOS. Features may require Camera, add-only Photos, Face ID or passcode authentication, Share Sheet, StoreKit, or mail link access.

5. Your Content and Responsibilities

You are responsible for the photos, project names, body measurements, comparison exports, and other content you capture, save, export, or share through the App. You must have the rights and permissions needed to use that content. Do not use the App to create, store, organize, or distribute unlawful, infringing, harmful, abusive, exploitative, or non-consensual content. Additional expectations are described in the Content Policy.

6. Local Storage and Backups

The App is designed for local-first use. You are responsible for maintaining device access, iOS backups, and any backups you need for important content. We are not responsible for data loss caused by device loss, deletion, operating system failure, unsupported modifications, or uninstalling the App.

7. Progress Camera Pro Purchases

The App offers optional Progress Camera Pro access through monthly and annual auto-renewable subscriptions and may offer a lifetime non-consumable purchase. The available products use StoreKit identifiers com.ly.PrivateProgressCamera.pro.monthly, com.ly.PrivateProgressCamera.pro.yearly, and com.ly.PrivateProgressCamera.pro.lifetime. Availability, localized price, currency, taxes, and eligibility are shown by Apple at purchase time.

Pro may unlock unlimited progress series, photos, and body-measurement history; full trends; arbitrary measurement comparisons; measurement details in exports; and other benefits displayed in the App. Free limits and Pro benefits may change in future versions, but changes do not alter an active entitlement contrary to applicable law or Apple's rules.

Payment is charged to your Apple ID when you confirm a purchase. Monthly and annual subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. Apple may charge your account for renewal within 24 hours before that period ends. You can manage or cancel subscriptions in your Apple ID subscription settings. Deleting the App does not cancel a subscription.

The lifetime option is a one-time, non-consumable purchase for Pro access associated with the purchasing Apple ID, subject to Apple's availability and restore rules. Use Restore Purchases to request that Apple resynchronize eligible entitlements. Refunds, billing disputes, Family Sharing availability, and payment processing are handled by Apple under its policies. We do not receive or store your full payment-card details.

8. Privacy

Our Privacy Policy explains how information is handled in connection with the App, including Camera access, add-only Photos saving, local photos and measurements, optional Face ID lock, Firebase Analytics and Crashlytics, purchases, sharing, and system services.

9. Intellectual Property

The App, software, design, branding, and related materials are owned by us or our licensors and are protected by intellectual property laws. These Terms do not transfer ownership of the App to you. You retain the rights you already have in your own content, subject to third-party rights and applicable law.

10. Restrictions

You agree not to reverse engineer, decompile, disassemble, modify, distribute, sell, rent, or sublicense the App except where applicable law prohibits such restrictions. You also agree not to interfere with App security, misuse Apple services, bypass feature limits, or use the App in a way that violates law or third-party rights.

11. No Medical or Professional Advice

The App provides photo capture, self-entered measurement tracking, charts, comparison, alignment, export, and organization tools. Measurements and trends are not verified medical readings. The App does not provide medical, health, fitness, dermatology, diagnosis, treatment, legal, privacy, security, financial, or other professional advice. You are responsible for consulting qualified professionals before making decisions based on photos, measurements, trends, or comparisons.

12. Disclaimers

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted operation, or error-free performance.

13. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, content, business, goodwill, device functionality, or personal outcomes arising from or related to the App. Our total liability for claims related to the App will not exceed the greater of the amount you paid for the App or in-app purchases during the twelve months before the claim, or USD 100, except where the law requires otherwise.

14. Termination

We may suspend or terminate access to the App if you materially breach these Terms or use the App unlawfully. You may stop using the App at any time. Sections that by their nature should survive will survive, including intellectual property, disclaimers, limitation of liability, and dispute provisions.

15. Changes

We may update these Terms from time to time. The updated version will be posted at this page with a new effective date. Continued use of the App after changes become effective means you accept the updated Terms, where permitted by law.

16. Governing Law

These Terms are governed by applicable laws, excluding conflict-of-law rules, except where mandatory consumer protection laws in your country or region require otherwise. Nothing in these Terms limits rights you cannot waive under applicable law.
